NATIVITY OF THE THEOTOKOS GREEK ORTHODOX CHURCH
This agreement is made and entered into as of __________________, 20____, by and between the Nativity of the Theotokos Greek Orthodox Church ("Lessor"), and _____________________________ ("Lessee"). Lessor and Lessee agree as follows:
Leased Space/Terms and Conditions: Lessor grants to Lessee the right to use and occupy the Nativity of the Theotokos Greek Orthodox Fellowship Hall (the "Hall") and the surrounding premises, including the parking lot, from 9:00 AM until Midnight the day of the event. Lessee may stay until 1:00 AM the day following the event to facilitate cleaning of the rented space.
Payment: Lessee shall lease the leased space for the basic rental of $1,000.00. The security deposit required by Lessee in connection with rental of the leased space is $500.00 (the "Security Deposit).
Cancellation and Refund: If the scheduled event is canceled by Lessee more than thirty days prior to the event period, the security deposit and the basic rent, minus a $100.00 administrative fee, will be returned to Lessee. If the scheduled event is canceled by Lessee less than thirty days prior to the event period, the security deposit and one- half of the basic rent will be returned to Lessee. If the scheduled event is canceled by Lessee less than three days prior to the event period, only the security deposit will be returned to Lessee.
Restoration of the Leased Space: LESSEE IS REQUIRED TO CLEAN UP THE LEASED SPACE FULLY AND TO RESTORE THE SAME TO THE CONDITION IN WHICH LESSEE FOUND IT. Should Lessee fail or refuse to clean up and restore the premises, Lessor shall do so and charge the full cost thereof against the security deposit.
Damages: Should any damage, destruction or losses occur to the leased space and/or to the center premises as a direct or indirect result of Lessee's use of any part of the leased space, Lessor shall repair same and shall apply the security deposit to such repair. If such damage or destruction exceeds such security deposit; Lessee agrees to pay the excess immediately upon demand.
Insurance: When food service is provided by a caterer, the caterer must submit a current Certificate of Insurance policy, holding the caterer liable for any food served. The insurance policy must name The Nativity of the Theotokos Greek Orthodox Church as additionally insured. If alcohol is being served, the party named on the VA ABC Banquet License shall also provide a current certificate of Insurance policy, holding him/herself liable for any alcohol served. The insurance policy must name The Nativity of the Theotokos Greek Orthodox Church as additionally insured.
Leased Space Capacity: Lessee shall not permit more persons into the leased space than can safely and freely move about, as determined by the Fire Marshall, which is 188 for the hall.
Decorations: Lessee may install decorations which do not injure or mar or in any manner deface the premises or any equipment of Lessor, and shall be responsible for removing the same and restoring the premises to their original condition. NO HOOKS, NAILS OR SCREWS, OR TAPE may be attached to any surfaces. No items may be hung from light fixtures, air conditioning ducts, grills or diffusers. No exit may be obstructed by decorations or by any other furniture or objects of any kind. Exit signs may not be defaced or blocked from normal line of sight. No gasoline or flammable materials or open flames, including candles, are allowed in the leased space, except for the normal and intended use in the kitchen and sanctified church services in the sanctuary. Decorations must be removed by Lessee immediately upon the event termination. No birdseed, rice, confetti, or glitter may be used inside the hall. Such use will result in forfeiture of the security deposit to cover cleaning/repainting of such items.
Parking: Free parking is provided Lessee during the event period, but such parking shall be solely in Lessor's parking lot. With the exception of the hall and reception area, the drinking of alcoholic beverages anywhere on the leased space is prohibited.
Alcoholic Beverages: Any and all use of alcoholic beverages must be in strict conformance with the Alcoholic Beverage Code of the State of Virginia. Serving of alcoholic beverages will be allowed only during the times of leased use of the premises, and with the Lessee obtaining the appropriate license from the VA State Department of Alcohol. No alcoholic beverages may taken out of the hall. If the serving of alcohol is observed by the LESSOR, and the LESSEE has not secured the proper Banquet License, the event will be closed by the LESSOR. Lessee agrees to defend, indemnify and hold harmless Lessor and its Parish Council, officers, Priest, agents, representatives and employees from any and all liabilities, demands, claims, losses, costs or expense, including, but not limited to attorneys' fees, arising out of or related to any damage to or loss of property, sickness, disease, damages, bodily injury, or death resulting from the consumption by any person of any alcoholic beverages, which consumption is directly and/or indirectly related to the Scheduled Event. Lessee is solely responsible for providing proper transportation for an obviously intoxicated guest. ABSOLUTELY NO GLASS BOTTLES FOR ANY BEVERAGE.
Food Preparation: Preparation of food in the leased space is not allowed, other than in the kitchen. The Lessee/Caterer is responsible for the handling of all food service requirements including set-up, serving and clean-up. Use of the kitchen is restricted to warming and setting up food. All church equipment and kitchen floor must be kept clean and damage free, otherwise, the client will be assessed a fee. Any use of propane, charcoal, flammable fuel, or pressurized tanks for cooking is not permitted. Sterno-type portable food warmers are permitted.
Cleaning: The Lessee/caterer is responsible for keeping the entire facility clean. All residual items must be removed from the premises at the end of the event. The church provides a cart, garbage cans, and trash bags. Trash bags must be placed in the outside dumpster at the end of the event. Failure to comply with these guidelines could result in the loss of the LESSEE security deposit.
Keys: Keys may be picked up no earlier than 9:00 AM the day of the event and should be left on the counter in the kitchen area upon vacating the premises.
Tables and Chairs. Lessee may use Lessor’s tables and chairs, as needed, in the leased space provided that same are replaced to the area where same are stored.
Acknowledgment of Lessee: LESSEE ACKNOWLEDGES THAT LESSEE HAS READ EACH AND EVERY PART OF THIS RENTAL AGREEMENT, INCLUDING THE POLICIES, AND FULLY UNDERSTANDS THE SAME, INCLUDING, BUT NOT LIMITED TO, THE INDEMNIFICATIONS OF LESSOR CONTAINED HEREIN.
